The worst part of my mother’s probate

I was accused of elder abuse.


The probate attorney argued that I abused my mother by asking for financial assistance from her, while I cared for her over 18 months.

I traveled to my mom’s home 2 or 3 time per day, 7 days a week, to administer medication and handle her custodial needs during a time my sister and brother were unable to help.


Three members of my rotary club were in the audience for other reasons. Being a newer member of rotary, the judge’s statement and probate attorney's argument was very embarrassing.

My sister and brother were very displeased with the outcome. I had been paid $40,000 for caring for my mom over about 18 months.

They had expected to share $100,000 two ways. However, after my mom’s house sold for $50,000 less than it was worth, and a probate attorney was paid $25,000, there was only $25,000 remaining to split two ways.

If my mother had a living trust, her estate would have shared $100,000 more with my mother’s children.
